Terms of Service

Skillpix reserves absolute, unrestricted, and irrevocable executive powers regarding the management of user accounts and content on the Platform. By using our Service, you explicitly acknowledge and agree that Skillpix administration and management retain the right to:

• Ban or Suspend Accounts: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
• Delete Accounts: We reserve the right to permanently delete any user account and associated data at our sole discretion without prior warning.
• Data Retention After Deletion: When an account is deleted — whether voluntarily by you or by Skillpix — we reserve the right to retain an internal archive of your account data for a default period of up to two (2) years. This archived data may be held for an indefinite period if placed under a legal hold (see Section 6 below). Submission of a deletion request does not constitute, and shall not be construed as, a waiver of our right to retain such data for legitimate legal, security, or operational purposes.
• Account Impersonation: Authorized Skillpix personnel may access, log in to, and operate user accounts for maintenance, debugging, security enforcement, or moderation purposes without prior notification to the user.
• Content Removal: We have the right to remove, edit, or block any content posted by users that we determine, in our sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

NO NOTICE IS REQUIRED FOR ANY OF THE ABOVE ACTIONS.

You agree to use the Platform only for lawful purposes. You are strictly prohibited from using the Service to:

• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
• Upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.
• Violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances, including but not limited to the Information Technology Act, 2000 (India) and its amendments, GDPR, and other applicable global cyber laws.

Zero Tolerance Policy: Any violation of Indian or worldwide laws regarding cyber harassment, hate speech, or illegal activities will result in an immediate and permanent ban. We will cooperate fully with law enforcement authorities requesting or directing us to disclose the identity of anyone posting such information or materials. This cooperation extends to disclosures from archived records of deleted accounts, and does not require your consent or prior notice to you.

To the maximum extent permitted by applicable law, in no event shall Skillpix, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

Skillpix assumes no liability or responsibility for any:

• Errors, mistakes, or inaccuracies of content.
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Service.
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
• User behavior, including offensive, defamatory, or illegal conduct of any third party. You specifically acknowledge that Skillpix shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Skillpix and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Skillpix.

These Terms shall be governed and construed in accordance with the laws of India, specifically the laws applicable in Tamil Nadu, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

By accepting these Terms, you explicitly acknowledge and consent to the following data retention and legal compliance practices:

Post-Deletion Archival: When your account is deleted — whether voluntarily by you or by Skillpix — a snapshot of your account information is archived in our secure internal systems. This archive is retained for a default period of up to two (2) years following the deletion date. The archived data may include, but is not limited to, your name, email address, account role and tier, subscription and billing history, the reason provided for deletion, the IP address from which the deletion was initiated, account creation and deletion dates, and any prior moderation or ban history.

Legal Hold: Skillpix reserves the right, at its sole discretion, to place any account archive under a legal hold, thereby suspending the scheduled purge date indefinitely. A legal hold may be imposed when Skillpix has a good-faith basis to believe the data may be relevant to:

• Ongoing or anticipated civil or criminal litigation;
• An active or potential investigation by a law enforcement agency, regulatory body, or government authority;
• A court order, subpoena, search warrant, or other lawful legal process;
• Any circumstance in which premature deletion could constitute spoliation of evidence or obstruction of justice.

A legal hold overrides any automated or scheduled purge and remains in effect until Skillpix expressly lifts it. You will not necessarily be informed when a legal hold is placed on your archived data.

Law Enforcement & Government Cooperation: Skillpix will comply promptly and fully with any valid request from law enforcement agencies, courts, regulatory authorities, or government bodies — in India or internationally — to disclose, transfer, preserve, or produce user data. This includes, but is not limited to:

• Court orders, judicial warrants, and search warrants issued by competent courts;
• Subpoenas or compulsory legal notices issued by government agencies;
• National security letters or intelligence directives;
• Requests under the Information Technology Act, 2000 (India) and its amendments, including the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
• Requests under the Digital Personal Data Protection Act, 2023 (DPDP Act), or any successor legislation;
• Requests made via Mutual Legal Assistance Treaties (MLATs) or any equivalent international cooperation framework;
• Any other applicable domestic or international law.

Such disclosures may encompass data relating to active accounts as well as archived records of deleted accounts. Skillpix is not required to notify you before, during, or after complying with such a request, unless expressly mandated to do so by applicable law.

YOUR DELETION OF AN ACCOUNT DOES NOT ERASE YOUR LEGAL EXPOSURE OR RELIEVE SKILLPIX OF ITS OBLIGATIONS TO RETAIN OR DISCLOSE YOUR DATA IN RESPONSE TO VALID LEGAL PROCESS.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
